The purpose of this paper is to analyze H.L.A. Hart’s concept of validity, developed in “The Concept of Law”, applied to the developments of authors Kingsbury, Krisch and Stewart on Global Administrative Law. Thus, try to arrive at certain conclusions regarding the validity of the norms attributed to it, emphasizing on the concept of the ultimate rule of recognition, and its existence as a legal system.

El objeto del presente trabajo es tomar el concepto de validez de la teoría de H.L.A. Hart, desarrollado en “The Concept of Law”, y aplicarlo a los desarrollos de los autores Kingsbury, Krisch y Stewart respecto del Derecho Administrativo Global. Se intentará arribar a valoraciones respecto del mismo en cuanto a la validez de las normas que se le atribuyen, partiendo desde el concepto de regla de reconocimiento última, y su existencia como sistema jurídico.

O objetivo deste trabalho é analisar o conceito de validade de H.L.A.Hart, desenvolvido em “The Concept of Law”, aplicado aos desenvolvimentos dos autores Kingsbury, Krisch e Stewart sobre o Direito Administrativo Global. Assim, procura-se chegar a determinadas conclusões quanto à validade das normas que lhe são atribuídas, enfatizando o conceito de regra última de reconhecimento, e a sua existência como sistema jurídico.
